We recommend that you consider mediation FIRST, unless you have urgent legal matters. This ensures that your negotiations are managed directly by you, with the support of the mediation process.
You will then need to involve a family lawyer in order to ensure that your legitimate self-interest is protected even if you are trying to be fair to your ex-partner. Oxfordshire Family Mediation works in partnership with family lawyers and we strongly recommend that you consult a solicitor during mediation so that you are negotiating on a properly informed basis. This is fair to you and fair to your ex-partner.
Mediators are impartial. They will give broad information to assist you in decision-making but will not give advice or hints about what might be best for you.
Collaborative Law is another option. This offers an opportunity for you to sit round a table, each with his or her own collaborative lawyer, to find a way to settle the finances which is manageable for you both. If you get stuck in mediation, or choose not to use it, you may wish to consider taking matters forward using this model.
