MIAM – Mediation Information Assessment Meeting
The Courts recognise that parents are generally best placed to know what is in their children's interests and are encouraging parents to work this out together, with the assistance of a qualified mediator. They and we acknowledge that mediation is not suitable in every case but for the vast majority it represents an opportunity for you to find the solution that best fits your individual circumstances.
From 6th April 2011 anyone applying to the Courts for assistance in resolving a dispute about parenting or finances following relationship breakdown will be expected to comply with the Pre-Application Protocol and to attend a meeting to learn about mediation.
The Mediation Information and Assessment Meeting is an individual meeting for you on your own (unless you both decide you wish to be seen jointly). This will give you the opportunity to explain the situation to the mediator and to hear about the process of mediation in the context of your individual circumstances. The mediator will discuss with you whether mediation would be suitable in your case and will assess you for eligibility for public funding (Legal Aid). If you do not qualify for legal aid the mediator will make sure you aware of the costs of mediation.
Mediation is voluntary. If you or your ex-partner decide that you do not wish to proceed you can request the mediator to provide a form (FM1) for the Court. This confirms that you have attended this mediation information meeting.
The cost for the meeting (and the form if required) is the same as our normal introductory session fee: £50 including VAT.
If you both agree to try mediation an appointment will be made for you to attend together at a convenient time and place.
